Gullickson<br />Ok I have been playing guitar for about 5 years. Electric Guitar for almost 2. I kinda got bored of not having a loud heavy distortion. Using any amp you can get heavy distortion by turning up the preamp high and the postamp down, but then the sound is barely audible. So when I got this I immeadiatly fell in love with it. The sound at first gave me too much feed back. So what you have to do is you have put your amp on clean. If you want to use your amp distortion for the entire song and then this pedal for the solo then you have to be playing from the moment you turn the distortion on til the moment you turn it off or else it screechs. The sugested settings (death scoop, smooth, knifes edge, and rectified) are good for getting used to the pedal, but after awhile you need to find your own settings. I love this pedal. I compared it to such pedals as the Metal Zone and The Boss Death Metal (digitech bought out Boss so they are the same, just the digitech has more crunch) and the Digitech Grunge. </p>
<p>My set up is a Washburn Dime 332 with light gauge strings and the factory pick-ups. My amp is a Peavey Rage 158. It&#8217;s a 10 watt, but with this pedal it sounds like a 30. It&#8217;s amazing. All those reviews you read that said you can&#8217;t get softer sounds are wrong.  You just need to use the volume setting on your guitar. If you turn it down low, you can get a blues tone out of it. </p>
<p>Now this thing is built like a rock, I have a good size dent in my floor now from when I dropped it, but the thing still sings. It is a mini tank. Even though you get good battery life I would suggest you still get the AC adaptor. </p>
<p>This pedal is perfect for any metal head! Don&#8217;t waste you time on the other pedals. This one is the best you can get, and it&#8217;s cheap too! </p>
<p>Review:<br />-Makes small amps sound huge, and huge amps sound&#8230; well just sound bigger.<br />-Can get soft sounds out of it<br />-Less expensive yet still as good<br />-Built like a tank!<br />-Gives you sounds of all good Metal Bands (Iron Maiden, Judas Priest, Slayer, Metallica&#8230; etc.)<br />-Excellent beginner/intermediate/advanced pedal.</p>

This pedal is decent but very thrashy in sound quality, shop around before you buy.  Try other pedals at a local retailer, and bring your amp in to hear what you would REALLY sound like, then, make a decision, and come back.</p>

<p>First off, you can&#8217;t really produce much of what I would consider authentic &#8220;Death Metal Distortion&#8221;, the distortion is kind of heavy, but is not much heavier than some of the stuff you can get from a normal distortion pedal. </p>
<p>When I first got this pedal, it had an enormous amount of feedback, so much in fact that I had to turn the volume and master knobs on my amp to around 1 or 2. Thankfully, with time, the feedback was died out a bit. The sounds you can produce are decent, not great, but are good enough for $50.</p>
<p>I&#8217;m not much of a guitarist (even though I fool around with it), I&#8217;m a quite experienced bass player, and I must say this pedal sounds terrible with basses. When you play notes in succession, its hard to hear whether you are playing a chord or whether you are playing separate notes as they all mesh together. Most notes are too low (especially when you play 6 string like I do) to decipher and end up sounding like garbage. I do not recommend for a bass player. </p>
<p>Overall, its an okay pedal, kind of muddy though, good if you can&#8217;t dish out for more expensive pedals, but it will do.</p>

<p>IRC  Section  72  governs  the  income  taxation  of  annuity  contracts.  IRC  Section  72(u)(1)  taxes  the  income  on  an  annuity  contract  owned  by  a  &#8220;non-natural&#8221;  person  by  treating  it  as  even though  it  was  received  by  the  non-natural  owner.  If,  however,  a  non-natural  person  is  plainly  keeping  the  contract  as  an  &#8220;agent&#8221;  for  a  natural  person,  the  income  on  the  contract  will  not  be  so  treated.  Unfortunately,  neither  the  Internal  Revenue  Code  nor  the  regulatings  explain  when  an  agency  arrangement  will  be  deemed  to  exist.</p>
<p>For  2010,  irrevocable  trusts  reach  the  most eminent  income  tax  rate  (35%)  at  $11,200  of  taxable  income.  In  comparison,  married  couples  filing  jointly  and  single  taxpayers  do  not  reach  the  35%  income  tax  rate  until  $357,700  of  taxable  income!  Thus,  wealthier  humans  tend  to  invest  in  trusts  for  growth  rather  than  for  income.  This  is  specially  true  for  credit  shelter  trusts  (also  known  as  family  trusts  and  residuary  trusts)  where  the  surviving  spouse  neither  needs  nor  wants  current  income,  but  wants  to  concede  the  trust  pluses  to  grow  &#8211;  estate  tax  free  &#8211;  for  the  gain  of  children  and  grandchildren.  If  an  annuity  contract  is  to  be  used  as  a  trust  investment,  the  critical  question  to  keep away from  current  income  taxation  becomes  whether  the  trust,  a  non-natural  person,  may  be  an  agent  for  it is  natural  person  beneficiaries.</p>
<p><strong>Single  Beneficiary  Trusts</strong></p>
<p>In  PLRs  9204010  and  9204014,  the  IRS  determined  that  a  trust  was  acting  as  an  agent  for  a  natural  person  when  it  purchased  an  annuity  for  the  sole  beneficiary  of  the  trust.  Under  the  terms  of  the  trust,  the  trustee  had  discretion  to  compensate  income  and  corpus  to  the  beneficiary  until  the  beneficiary  attains  age  40,  at  which  point  the  entire  trust  corpus  (including  the  annuity  contract)  was  to  be  disseminated  to  the  beneficiary.  The  IRS  merely  concluded  that  the  trustee&#8217;s  ownership  of  the  annuity  contract  was  nominal  equated  to  that  of  the  beneficiary  and,  consequently,  the  beneficiary  was  the  beneficial  proprietor  of  the  annuity  contract.  The  PLRs  did  not  address  what  bearing,  if  any,  there  would  be  on  the  ruling  if  the  beneficiary  passed away  prior  to  age  40  and  the  trust  property  passed  to  a  contingent  remainder  beneficiary.</p>
<p>In  PLRs  200449011,  200449013,  200449014,  200449015,  200449016  and  200449017,  with  closely  identical  facts,  the  IRS  determined  that  the  trust  was  acting  as  an  agent  for  a  natural  person  when  it  purchased  an  annuity  contract  for  the  sole  gain  of  the  grantor&#8217;s  grandchild.  In  those  rulings,  the  annuity  contracts  were  to  be  passed around  in-kind.  The  PLRs  did  not  address,  however,  what  the  tax  aftermaths  would  be  beneath  IRC  Section  72  if  any  distribution  from  the  trusts  were  in  cash.</p>
<p><u><strong>Multiple  Beneficiary  Trusts</strong></u></p>
<p>In  PLR  9752035,  the  IRS  determined,  with  no  discussion,  that  a  trust  was  acting  as  an  agent  for  a  natural  person  when  it  purchased  an  annuity  contract.  In  PLR  9752035,  there  was  a  life  income  beneficiary  (who  was  also  the  annuitant)  and  remaindermen.  Although  the  outcome  of  PLR  9752035  was  favorable,  it  provides  little  guidance  as  to  when  a  trust  is  acting  as  an  agent  for  a  natural  person.</p>
<p><u><strong>Trust  Distributions</strong></u></p>
<p>IRC  Section  72(e)(4)(C)  provides,  in  part,  that  if  an  person  transfers  an  annuity  contract  without  full  and  adequate  consideration,  the  person  will  be  taxed  on  the  amount  in  excess  of  the  contract&#8217;s  surrender  value.  However,  in  PLR  199905015  and  PLR  9204014,  the  IRS  ruled  that  IRC  Section  72(e)(4)(C)  does  not  utilise  when  an  annuity  is  transposed  in-kind  from  a  trust  to  the  beneficiary.  The  trust  beneficiary  would  plainly  become  the  owner  of  the  annuity  contract,  would  inherit  it is  cost  basis,  and  would  proceed  to  take delight in  it is  tax-deferred  status.</p>
<p><u><strong>Other  Section  72  Issues</strong></u></p>
<p><em>Required  Distributions</em>.  IRC  Section  72(s)  sets  forth  the  required  distribution  rules  which  an  annuity  contract  must  satisfy  upon  the  death  of  the  holder  of  the  annuity  contract.  Following  is  a  summary  of  those  rules:</p>

<li>If  the  holder  dies  after  the  annuity  starting  date,  the  remaining  interest  ought to  be  disseminated  at  least  as  quickly  as  the  method  of  distributions  being  applied  at  the  date  of  the  holder&#8217;s  death.</li>

<p>What  if  the  irrevocable  trust  is  a  &#8220;grantor&#8221;  trust  for  income  tax  purposes  and  the  grantor  and  annuitant  (normally  the  trust  beneficiary)  are  not  the  same  person?  While  not  clear,  arguably  the  grantor  will have to  be  treated  as  the  holder  of  the  contract.  If  so,  then  it  would  be  the  grantor&#8217;s  death  (not  the  annuitant&#8217;s)  that  would  determine  when  distributions  from  the  contract  ought to  be  made.</p>
<p>Penalty  for  Premature  Distributions.  IRC  Section  72(q)  imposes  a  10%  penalty  tax  on  untimely  distributions  from  an  annuity  contract.  Generally,  the  penalty  tax  applies  to  distributions  to  the  &#8220;taxpayer&#8221;  prior  to  attaining  age  59  &amp;frac12;.  If  the  annuity  contract  is  owned  by  a  trust,  then  who  is  the  &#8220;taxpayer&#8221;  for  intents  of  IRC  Section  72(q)?</p>
<p>As  discussed  above,  the  annuitant  is  treated  as  the  holder  of  a  trust-owned  annuity  for  intents  of  the  required  distributions  upon  the  death  of  the  holder.  Thus,  it  is  logical  to  look  at  the  annuitant  for  intents  of  applying  the  age  59  1/2  exception  for  the  untimely  distribution  penalty.  Assuming  the  annuitant&#8217;s  age  is  not  the  applicable  measure,  then  presumably  it  will have to  be  the  beneficiary&#8217;s  or  beneficiaries&#8217;  age.  If  so,  will have to  all  the  beneficiaries  be  over  age  59  1/2  for  the  exception  to  apply?  Moreover,  if  the  irrevocable  trust  is  a  grantor  trust,  is  the  penalty  then  based  on  the  grantor&#8217;s  age?  Unfortunately,  each  of  these  questions  remains  unanswered.  To  refrain from  these  issues,  considerateness  must  be  given  to  disseminating  the  contract  straightout  to  the  beneficiary  before  the  date  withdrawals  are  to  begin.</p>
<p><u><strong>Designing  the  Trust</strong></u></p>
<p>Keeping  in  mind  that  the  PLRs  cited  above  are  only  binding  on  taxpayers  who  requested  the  ruling,  they  do  suggest  that  an  annuity  contract  acquired  by  an  irrevocable  trust  or  credit  shelter  trust  may  provide  tax  deferral.  But  outstanding  care  ought to  be  exercised  to  make  sure  that  both  the  trust  and  annuity  contract  are  the right way  structured.  Consider  these  elements  when  setting  up  a  trust-owned  annuity:</p>

<li>If  the  annuitant  were  to  die  while  the  annuity  contract  was  still  held  in  trust,  the  contract  will  likely  have  to  be  liquidated  in  five  years. </ul>
<p>Although  trust-owned  annuities  implicate  a  significant  degree  of  complexity  and  uncertainty,  they  may  be  exceedingly  beneficial. It has worked as planned and I haven&#8217;t had any issues with it at all &#8212; it holds the iPad safely and securely, and the fact that it attaches to the TOP of the microphone stand (rather than the side of the stand) makes it flexible enough to position anywhere I need it. We have a 7 piece band, and fitting everyone on stage has been tricky. Setting the iPad on the end of a boom stand gave me the ability to position the iPad in a different spot each night next to my Nord Electro. A perfect on-stage performance tool until Akai actually ships its iPad-integrated Synthstation49.</p>

For some reason, they used black paint that comes off very easily, with just sweaty hands. I&#8217;m not a real drummer, so maybe you&#8217;re supposed to tape them up or something, but I was really disappointed there is no lacquer coating or anything to keep the paint from rubbing off. If I need to get another set, they will not be painted.</p>
